Submission Terms
SUBMISSIONS WILL BE ACCEPTED ON AGREEMENT OF THE FOLLOWING TERMS

All wine submitted becomes the property of Air New Zealand Limited.

The case volumes offered will be available for a minimum period of 30 days from the date of the tasting, by which time Air New Zealand will have confirmed whether or not it has been accepted.

The tasting of wines will occur in September 2024.

Wineries may choose to submit wines to all or any of the categories.
ONLINE SUBMISSIONS
Air New Zealand invites wine producers and distributors to submit wines via the online submission form for consideration for selection on board.
Electronic entry assists both the wine producer and Air New Zealand by ensuring the accuracy and reducing duplication when entering wines during this tender process.
The online submission process will require you to do the following:

Register your winery’s details. Please note if you are a distributor representing one or more wineries, the online submission will enable you to submit your details and details for each of the wineries you represent.

Enter each of the wines being submitted for consideration.

Review the completed proposal before confirming the submission.
When you have completed the online form, you will be emailed a summary of your submission including a unique reference code (submission code) against each of the wines submitted. This submission code is to be used during any follow-up enquiry of a wine contained in your submission. The online submission will allow you to attach a copy of your winemaker’s notes for each wine submitted.

SUSTAINABILITY
Supplier Code of Conduct
Successful applicants will be required to provide positive assurance you meet the expectations and minimum standards set out in our Supplier Code of Conduct, including in respect of labour, human rights, environmental sustainability and ethical business. You can access the Supplier Code of Conduct here.
Please indicate on the online submission form any of your wines that have been produced under certified sustainable programmes. Sustainability Fundamental requirements:
All wines must be made 100% from grapes grown in New Zealand.
All of the grapes, wine making and packaging facilities used in the production of the proposed wines must be wholly certified in accordance with a recognised, independently audited sustainability programme, e.g. Sustainable Winegrowing New Zealand or a recognised certified organic programme.
SUPPLIERS
Successful entrants will receive a contract from Air New Zealand for the supply of wine.
PRICING REQUIREMENTS
All selected wines will be subject to the following:

All successful Suppliers will be contacted by the Airline advising that a wine, or wines, from their submission has been selected based on quality, through the tasting process.

The Airline will seek to undertake a negotiation process with each successful winery with the objective of reaching an agreed commercial arrangement.

All negotiated wines from Business Premier submissions will be purchased as an Export sale (net of Excise and Duty), and unless otherwise agreed, will be DDU (Delivered Duty Unpaid) FIS (Free In Store) to the Airline’s logistics warehouse.

Negotiated wines from Tier 1 Lounge submissions will be purchased including Excise and Duty, and unless otherwise agreed, DDP (Delivered Duty Paid), with a small portion purchased as an Export sale (net of Excise and Duty), and unless otherwise agreed, will be DDU (Delivered Duty Unpaid) FIS (Free In Store) to the Airline’s logistics warehouse.

The price negotiated and accepted shall be binding.

The price negotiated and accepted will include provision for the supply of samples, labelling, delivery and other requirements of Air New Zealand Limited.
PERFORMANCE OF CONTRACT

If the successful Supplier defaults in the performance of a contract, the Supplier will receive 10 days to rectify the default and, should the default continue after that period, Air New Zealand Limited reserves the right to cancel the contract.

Upon being contacted by Air New Zealand Limited and a price being agreed upon, at the airline’s discretion, the Supplier may be asked to enter into a contract or issued a purchase order containing our standard terms.
DELIVERY

The specified quantity shall be delivered upon issue of call-off as and when required.

Product risk is to be the responsibility of the Supplier until uplifted by Air New Zealand Limited or their agent.

A grace period of up to seven days after the call-off date may, at Air New Zealand Limited’s discretion, be granted for call-offs (Weekends and Public Holidays inclusive), after which Air New Zealand Limited reserves the right to cancel the contract.
PACKING AND PACKAGING

The wine must be suitably packed and packaged for sea-freight or airfreight depending on the applicable transport mode in accordance with Air New Zealand Limited’s specifications and/or standard trade practices.

The Supplier is liable for damages resulting from inadequate packing or packaging.

Case markings. All cases or outers must show clearly the following on either the end or side of the carton:

A front bottle label to be affixed on the carton end or the name of the wine clearly indicated on the carton

An indication on how the bottles are packed e.g. upright or flat.

Pallets must be delivered with dimensions no greater than 1.0m x 1.2m x 1.4m
PRESENTATION
-
Labels, capsules and bottle specifications must be as per the approved samples unless agreed otherwise.
-
Bottle labels must conform to the relevant New Zealand Label Regulations of the Food Regulations 1984
QUALITY AUDIT
-
Each wine purchased must have a current NZ Wine Export Certificate or be export eligible and the winemaker is required to have produced the wine under their own Winemakers/Winery license, and at all times have complied with the Winemaking provisions of the Food Act 1981.

Each time a new batch is forwarded to Air New Zealand Limited, three bottles will be forwarded to the wine consultants for quality audit of the wine. The cost of supply and delivery of this wine will be included as part of the purchase price.

Supplier to warrant that the wine will be of merchantable quality and conform to the samples evaluated by the Wine Consultants. This includes batch number verification.

In the event any Suppliers are found not to conform, then the Supplier and Air New Zealand Limited shall meet within 14 days to seek to resolve any problems arising.

Any product supplied which is found to be faulty will be charged back to the Supplier at cost plus distribution costs. A reasonable administration charge will also be charged.

Supplier to indemnify Air New Zealand Limited in respect of any liability incurred by supply of defective wine.
PUBLICITY
Any publicity, promotion or promotional material arising from the sale of wine to Air New Zealand Limited, that uses the logo or name of Air New Zealand must have the written permission of Air New Zealand Limited.

TERMS OF PAYMENT
Standard 20th of the following month terms apply.

Both parties to the contract shall keep all details confidential and limited to those Employees who need to know.
